Terms of Service

1. Introduction

These Terms of Service ("Terms") are a legal agreement between you and Bachlette ("we", "us", "our") covering the Bachlette mobile application for iOS and Android (the "App") and the bachlette.com website (together, the "Service").

By downloading, buying, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains what we do with your information and forms part of these Terms.

2. Who we are

Bachlette is operated by Kirstie Lee Fuller, a sole trader in Queensland, Australia, ABN 30 517 427 873. You can reach us at [email protected].

We are based in Australia and sell the App from Australia. It is sold on the App Store and Google Play in every market except the European Economic Area and the United Kingdom, where it is not offered for sale.

3. Age requirement

You must be at least 18 years old to use the Service, whether as a host or as a guest.

Bachlette is a party game for adults. In Wild mode the game catalogue includes adult themes, sexual references, and prompts about drinking. If you are under 18, do not create an account and do not join a party.

4. What Bachlette is

Bachlette is a party game app for bachelorette, hens and bridal shower parties. In short:

  • A host buys the App once and creates a party. The host chooses the party's name, its mode, and who the bride is.
  • Every party is either Wild (bachelorette) or Mild (bridal shower). The host sets the mode when the party is created, and it fixes the game catalogue and the look of the App for everyone in that party.
  • Creating a party produces an access code. The host shares that code however they like.
  • Guests enter the code and a display name, and join free. Guests are not asked to buy anything, and are never asked for an email address or a password.
  • Everyone plays on their own phone. Votes, guesses, claims and bingo progress feed a live leaderboard.

We may add, change or remove games and features as the App develops. We will not remove a feature you have paid for without reasonable notice.

5. Your account

5.1 Host accounts

To host, you create an account with an email address and password, or by signing in with Apple or Google. You are responsible for keeping your sign-in details confidential and for everything done through your account. Tell us at [email protected] if you think your account has been compromised.

You choose a display name. It is free text apart from the one check described in Section 10, it is visible to everyone in any party you join, and it must not impersonate anyone else or breach Section 10.

5.2 Guest accounts

Joining a party as a guest creates an anonymous account on your device. It holds your display name and your game activity in that party, and nothing else. There is no password to it and no way to sign back into it from another device.

The display name you pick when you join is checked the same way a host's is, so a name can be refused and you will be asked for another. Section 10 says what that check covers.

An anonymous account is tied to the App on the phone you joined from. If you delete the App, change phones, or clear the App's data, that account and your place in the party are not recoverable, and you would need to rejoin with the code while the party is still running. Guests who want a durable account can create a full one, but hosting requires a purchase (Section 6).

6. Buying Bachlette

6.1 One purchase, not a subscription

Bachlette is a single purchase, not a subscription. Nothing renews, nothing recurs, and there is nothing to cancel. In Australia it is A$14.99; every other storefront is priced separately, and the store shows you the exact amount in your own currency before you confirm. The App displays whatever the store quotes rather than a price of its own.

The purchase is attached to your Bachlette account, not to a single party or a single phone. Once you have bought it you can create as many parties as you like, over as many events as you like, and sign in on another device to reach them.

Guests never pay. A guest joining your party with a code needs no purchase of their own.

6.2 How payment is taken

The purchase is processed by Apple In-App Purchase or Google Play Billing, under their terms and their payment policies, and charged to the store account you bought it with. We never see or hold your card, bank or billing details.

We use RevenueCat to confirm purchases. It tells the App whether your store account holds the unlock, and it notifies our server when you buy, when a purchase is refunded, and when an unlock is transferred to another store account.

The App cannot unlock itself. The flag on your account that says Bachlette is unlocked is written by our server, on RevenueCat's notification, and by nothing else. Section 4.6 of the Privacy Policy sets out what we record about a purchase, and Section 9 how long we keep it.

6.3 Restoring a purchase

Your purchase belongs to the store account you bought it with, your Apple Account or your Google account, not to your Bachlette account and not to the phone you bought it on. That is what makes it restorable: reinstall the App, move to a new phone, or sign in to a brand new Bachlette account, and the same store account still owns it.

Tap Restore purchase and we ask the store. It is in two places: on the purchase screen, and in the menu opened from the home screen's header. If the store account you are currently signed in to has not bought Bachlette, Restore tells you so rather than unlocking anything. If you paid with a different Apple or Google account, sign in to that one on your device and restore again.

6.4 Refunds

Refunds for App Store and Google Play purchases are handled by Apple and Google under their own policies, not by us. Request one through the store you bought from. Your rights under the Australian Consumer Law (Section 7) are in addition to this and are not affected by it.

A refund locks the App again. When a store tells us a purchase has been refunded, or that the unlock has been transferred to a different store account, we remove the unlock from the account that held it. Parties you have already run are not deleted by this, and Section 12 governs what happens to a party when it ends.

7. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where a term of these Terms would do so, that term does not apply to you.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Where the App is supplied as goods, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, and to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Where we are permitted to limit our liability under the Australian Consumer Law, our liability is limited, at our option, to resupplying the Service or paying the cost of having it resupplied.

If you are a consumer somewhere other than Australia, you may have similar rights under your own local law that these Terms do not displace.

8. Hosting a party

If you create a party, you are responsible for it.

The access code. Anyone who has the code can join your party, enter any display name they choose, and see the party's content. There is no approval step and no invitation list. Share the code only with people you want in the party, and be aware that a code you post somewhere public is a party anyone can walk into.

The people in it. You choose who the bride is and you may enter display names on other people's behalf. Only do that for people who are happy to be in the party. Section 6 of the Privacy Policy covers this from the privacy side.

Removing someone. You can remove a guest from the party's member list. The App asks you to confirm, and the guest is then shown a note saying the host removed them. Removal deletes nothing they have already done in the party, and it is not a block: nothing stops them joining again with the same code, as a new guest, while the party is running. You cannot remove yourself, and you cannot remove a guest whose Scavenger Hunt list is waiting on your decision until you have approved it or sent the tasks back. If a guest keeps causing a problem, your options are to end the party (Section 12) or to contact us at [email protected]. A prompt can be reported from the screen it is on (Section 10), but that is a way to tell us about words, not a way to remove a person.

Games with drinking prompts. Wild mode includes prompts about drinking. Nothing in the App requires anyone to drink, the host can turn individual prompts off before the party starts and between rounds once it is running, and it is up to the host and each guest to play responsibly and within the law. We are not responsible for what anyone chooses to drink.

9. Content you create

9.1 What counts as your content

Bachlette ships with a catalogue of games and prompts. When a party is created, that party gets its own copy of the prompts for the games it uses, and the host can:

  • rewrite the text of a prompt,
  • turn individual prompts on or off,
  • edit the answer options, the correct answers, and the accepted spellings for typed answers,
  • and set the party name and the names used in it.

A prompt, a display name, a party name or one of the couple's names can be refused when you save it, if it contains something from the list described in Section 10. Nothing else you write is refused, and what you typed stays in the field so you can change it.

Anything you write, including your display name, party names, and every word you type into a prompt, is your content.

9.2 The licence you give us

Your content is shown to other people. A prompt a host edits is read by every guest in that party, and display names and game activity are visible to everyone in the party. That only works if you let us store it and show it.

So, by creating content in the App, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, back up, and display that content to the other members of the party it belongs to, and to any device you use to reach that party, for as long as we hold it. That licence exists solely so we can run the party. It ends when the content is deleted (Sections 12 and 13), with one exception: where a prompt has been reported, the copy held in that report is kept for twelve months and the licence lasts as long as the copy does (Section 10).

We do not claim ownership of anything you write. We do not use your content to advertise, we do not show it to anyone outside your party, we do not sell it, and we do not use it to build or train anything. If we ever wanted to do any of those things we would have to ask you first, and change this section before we did.

9.3 What you promise about it

You promise that your content is yours to write, that you have the right to grant the licence above, and that it does not breach Section 10.

9.4 Our content

The games, the prompt catalogue we ship, the App's design and code, the Bachlette name and branding, and the website all belong to us and are protected by intellectual property law. Your purchase gives you the right to use the App, not to copy, resell, or republish what is in it. An edit you make to one of our prompts is yours; the prompt you started from stays ours. These Terms grant you no right to our trademarks or branding.

10. Acceptable use

You agree not to use the Service to:

  • break any law, or encourage anyone else to;
  • harass, bully, threaten, defame or humiliate anyone, whether they are in the party or not;
  • write prompts or display names that are hateful, that sexualise a minor, or that reveal someone's private information;
  • impersonate another person;
  • upset or endanger the bride, a guest, or anyone else the game is played about;
  • get into accounts, parties or data that are not yours, including by guessing access codes;
  • interfere with the Service, its security, or the servers behind it, or try to work around any limit in the App;
  • copy, decompile, reverse engineer, resell, rent or redistribute the App or its content, except where law says you may despite this term;
  • or use anything automated to scrape, flood, or drive the Service.

A party is a private space, and we do not monitor it. We do not read prompts, display names, or game activity as a matter of course. One automatic check does run, and it is narrow: display names, party names, the couple's names and prompt text are compared against a short fixed list of slurs and terms that sexualise a minor, and anything on that list is refused at the moment you save it. Nothing else is checked, nothing you write is stored, scored or flagged because of the check, and no person reads it. It is a floor, not moderation: it will not catch everything, and reporting (below) is still how anything else reaches us.

Reporting a prompt. Every prompt can be reported from the screen you are reading it on. There is a flag at the top of every screen that shows a prompt, in the same place on all of them. In the games that show one prompt at a time it reports that prompt; in the checklist games, the Scavenger Hunt and Bridal Bingo, it asks which prompt you mean first. Choose a reason, add a note if you want to, and send it.

A report comes to us, not to your host. Nobody else in the party is shown it or told that it exists, and the game carries on playing while you send it.

We read reports and act on them within 24 hours. What we do depends on what we find, and can include removing content, ending a party, or suspending or deleting the account behind it. A report holds a copy of the prompt as it was worded when you reported it, and is kept for twelve months, so it survives the party it came from and can still be acted on after that party is gone. Section 4.7 of the Privacy Policy says exactly what is in one.

You can also email [email protected] with the party name and what you saw, and that is the right route for anything that is not about a particular prompt.

What the App still cannot do. There is no way to block another person. A host can remove a guest from a party (Section 8), but that is not a block, and nothing stops the guest joining again with the same code. If the problem is a person rather than a prompt, report it or email us, and remember that a host can end the party at any time (Section 12).

11. Availability

We aim to keep the Service running, but we do not promise it will be uninterrupted or error free. It depends on services we do not control, including Apple, Google, and our hosting provider, and on your own device and internet connection.

We may suspend the Service for maintenance, and we may change or discontinue features. If we ever discontinue the Service altogether, we will give reasonable notice, and Section 7 continues to apply to what you paid.

12. When a party ends

Ending a party is final. When a host ends a party, the App confirms it first. After that:

  • the access code stops working, and nobody new can join;
  • guests are shown the final results and standings, then returned to the start;
  • the party leaves the host's list of parties, and neither the host nor any guest can reopen it or go back into it to see its content again.

Everything in the party is then deleted automatically, seven days after it ends. The party, its members, its prompts, and every vote, claim and bingo card in it are permanently removed, without anyone doing anything. Ending a party is the only way a host can shut one down, so treat it as deletion with a week's grace, not as an archive.

A party that is never ended has no end date to count seven days from. If it was started, it is deleted sixty days after it started, with everything in it. If it has not started yet, it is kept until the host ends it or deletes their account, because hosts create parties months before the event.

A guest's anonymous account is deleted once it is more than a day old and belongs to no party. Their display name and game activity have already gone with the party.

One thing outlives the party. If someone reported a prompt in it, that report holds a copy of the prompt and is kept for twelve months from the day it was filed, so it survives the seven days and survives the deletion of any account named in it. That is what makes a report worth filing on the last night of a party. Section 10 above describes reporting, and Sections 4.7, 9 and 10 of the Privacy Policy describe what a report holds and how long for.

Save anything you want to keep, such as a photo of the final leaderboard, before you end the party. We cannot restore a deleted party for you.

Section 9 of the Privacy Policy describes the same retention rules from the privacy side.

13. Deleting your account

You can delete your account at any time in the App, by tapping the menu button (the three lines) in the home screen's header and then Delete account, or by emailing [email protected]. The data deletion page sets out both routes and what each one removes.

Guests do not have an account to delete. A guest joins with an anonymous session, not an account, so Delete account applies to hosts, who create accounts. A guest can leave a party at any time: tap the menu button (the three lines) in the party screen's header, then Leave party. A guest's display name and activity are deleted with the party, and the anonymous session record is deleted automatically once every party it joined has been deleted (Privacy Policy, Sections 5 and 9).

Deletion is permanent and immediate. It removes your account, your email address, your display name and profile, any push tokens, every party you hosted along with everything in it, and your membership of any party you joined along with your display name, votes, claims and bingo progress in it. It is not a deactivation and it cannot be undone.

If you are hosting a party when you delete your account, that party ends immediately for everyone in it and its content is deleted with it. The App warns you and names the party before you confirm.

Deleting your account does not refund your purchase, and it does not entitle you to buy the App again for free. Your purchase lives with the store account you bought it from, so restoring it means signing in to a new Bachlette account and restoring through Apple or Google (Section 6.3). Your rights under Section 7 are unaffected.

14. Suspending or ending your access

We may suspend or terminate your access to the Service if you breach these Terms, if we are required to by law, or if your use of the Service puts other users or the Service itself at risk. Where it is reasonable to do so, we will tell you first and give you a chance to put it right.

If we terminate your access for a breach, you are not entitled to a refund, except where the Australian Consumer Law or another law says otherwise.

You can stop using the Service at any time by deleting your account (Section 13).

15. Third-party services

The App relies on services we do not operate: Supabase for its database and accounts, Expo for app updates and notifications, Apple and Google for distribution, sign-in and billing, and RevenueCat for confirming purchases. Their terms apply to you as well as ours when you use the App, and we are not responsible for how they run their services. Section 8 of the Privacy Policy lists them and what each one handles.

16. Disclaimers

Subject to Section 7, and to the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Bachlette is a party game. Nothing in it is advice of any kind, and the games are entertainment, not fact. We do not vet what hosts write, and we are not responsible for the content of any party or for what anyone does at one.

17. Limitation of liability

Subject to Section 7, and to the maximum extent permitted by law:

  • we are not liable for indirect, incidental, special, consequential or punitive loss, or for loss of profit, opportunity, data or goodwill, arising from your use of the Service;
  • we are not liable for content written by a host or a guest, for anything that happens at a party, or for a party you lose because it was ended, deleted, or reached the end of its retention window as described in Section 12;
  • and our total liability for all claims arising out of or relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.

18. Additional terms for the Apple App Store

These terms apply to the App as downloaded from the Apple App Store, and prevail over anything inconsistent elsewhere in these Terms:

  • These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
  • Scope of licence. Your licence to use the App is non-transferable, and limited to use on an Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
  • Maintenance and support. We are solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any.
  • Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
  • Product claims. We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  • Intellectual property claims. If a third party claims the App infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
  • Contact. Questions, complaints or claims about the App should be directed to Kirstie Lee Fuller at [email protected].
  • Third-party terms. You must comply with any applicable third-party terms of agreement when using the App.
  • Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and on your acceptance of them Apple has the right to enforce these Terms against you as a third-party beneficiary.

19. Additional terms for Google Play

The App downloaded from Google Play is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App. Refunds for Google Play purchases follow Google's refund policy.

20. Governing law

These Terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them.

If you are a consumer somewhere else, this does not take away the protection of the mandatory laws of the country you live in, or your right to bring a claim in your local courts where that law gives you one.

21. General

Severability. If any part of these Terms is found unenforceable, the rest stays in force.

No waiver. If we do not enforce a term straight away, we have not given up the right to enforce it later.

Assignment. You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets, and will tell you if we do.

Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.

22. Changes to these Terms

We may update these Terms. When we make material changes we will notify you by email or in-app notice before they take effect, and update the date at the top. Continued use of the Service after the effective date means you accept the updated Terms. If you do not accept them, stop using the Service and delete your account.
